General Terms and Conditions (GTC)

1 Scope of application
The General Terms and Conditions (hereinafter referred to as “GTC”) apply to all legal transactions concluded via the online store (hereinafter referred to as “online store”) via the homepage “ www.sarbach.swiss” and on site in a branch of SZG Sarbach Center for Health (hereinafter referred to as “SZG”). The online store and SZG are operated by TCM SinoSwiss Sarbach GmbH (hereinafter referred to as “TCM SinoSwiss Sarbach”). Registered office: Balacker 21, CH-3924 St. Niklaus. TCM SinoSwiss Sarbach reserves the right to amend these GTC at any time. The version of these GTCs valid at the time of the order is authoritative and cannot be changed unilaterally for this order. Any terms and conditions of the customer that conflict with or deviate from these GTC are not recognized.
The products and services offered in the online store and SZG are aimed at customers worldwide.
Deliveries are made to addresses in Switzerland and internationally.
The offer is valid as long as the product can be found via the search engine in the online store and SZG and/or stocks last.
Orders in quantities not customary for households may be rejected without justification.
2 Information
2.1 Product and price
Images of products in advertising, brochures, online store, etc. are for illustrative purposes only and are non-binding.
All sales prices published in the online store and SZG are final prices; all taxes (in particular VAT), any advance recycling fees (ARF), costs for packaging, delivery costs and all other possible charges, fees or costs are clearly stated. TCM SinoSwiss Sarbach reserves the right to change the prices of the products and services offered at any time. The price in the online store at the time of the order is decisive for the conclusion of the purchase contract.
2.2 Availability and delivery times
TCM SinoSwiss Sarbach attaches great importance to providing up-to-date and accurate information on availability and delivery times in the online store and SZG. However, delivery delays may occur, particularly due to production or delivery bottlenecks. All information on availability and delivery times is therefore without guarantee and may change at any time.
3 Conclusion of contract
The products and prices in the online store are deemed to be an offer. However, this offer is always subject to the condition that the contract is dissolved if delivery is not possible or if the price is incorrect.
The purchase contract for products or services of TCM SinoSwiss Sarbach is concluded as soon as the customer places their order in the online store or SZG, in one of the branches, by telephone or e-mail (hereinafter referred to as “purchase contract”).
The arrival of an online order is indicated to the customer by means of an automatically generated order confirmation from Onlineshop sarbach.swiss to the e-mail address provided by the customer. Receipt of the automatically generated order confirmation does not constitute a promise that the product can actually be delivered. It merely indicates to the customer that the order placed has been received by the online store and that the contract with TCM SinoSwiss Sarbach has therefore been concluded, subject to availability and correct pricing.
4 Delivery date
A provisional delivery date is communicated to the customer with the order confirmation or the customer is contacted and an individual delivery date is agreed.
If Onlineshop sarbach.swiss or SZG is in default of delivery, the customer has the right to withdraw from the contract from the 30th calendar day after the originally announced delivery date (except for special orders). In this case, sarbach.swiss shall reimburse the customer for any amounts already paid in advance. There are no further claims against sarbach.swiss online store or SZG and TCM SinoSwiss Sarbach.
5 Delivery / branch collection
For products and services from TCM SinoSwiss Sarbach, customers have all delivery and collection options available to them, which are noted in the online store sarbach.swiss or in the SZG.
If the customer does not accept the ordered products on the agreed or indicated delivery date, TCM SinoSwiss Sarbach may terminate (cancel) the contract and charge the customer for the delivery costs incurred and any loss of value.
If the customer does not collect the products ordered from a branch (branch collection) within 14 calendar days of the date on which they are ready for collection from the branch, TCM SinoSwiss Sarbach may terminate (cancel) the contract.
6 Duty to inspect
The customer must check delivered or collected products immediately for correctness, completeness and delivery damage.
Delivery damage, incorrect and incomplete deliveries must be reported to TCM SinoSwiss Sarbach via the online store sarbach.swiss or in the SZG within 5 calendar days from the time of collection or delivery. The customer is aware that such a report must be made via the personal customer account in the online store. The customer may not put such a product into operation or use it. They must return it as received in its original packaging or hand it in at one of the branches.
7 Warranty
7.1 Basic provisions
TCM SinoSwiss Sarbach guarantees that the ordered product is free of defects and functional for 2 months after delivery or collection from the branch. The guarantee period continues regardless of the provision of any guarantee services. TCM SinoSwiss Sarbach can provide the guarantee either through
• free repair (original guarantee period continues for all products);
• partial or complete replacement with an equivalent used product.
• replacement with a new product by TCM SinoSwiss Sarbach (new guarantee period of 2 months from replacement)
• credit at the current price (maximum of the sales price at the time of the order); or
• reduction.
Wear parts such as batteries, rechargeable batteries, power cables, adapters, lamps and software problems are excluded from the guarantee by TCM SinoSwiss Sarbach. Otherwise, the exclusions of liability according to section 8 apply.
If the manufacturer's guarantee goes beyond the guarantee of TCM SinoSwiss Sarbach, TCM SinoSwiss Sarbach also grants this to the customer.
TCM SinoSwiss Sarbach can provide the customer with a replacement product / exchange product at its own discretion while the guarantee claim is being examined (exchange subject to reservation). This is done under the (suspensive) condition that a guarantee case actually exists. The customer therefore only acquires ownership of the replacement product at the time of the guarantee promise by TCM SinoSwiss Sarbach. If a guarantee case is rejected by TCM SinoSwiss Sarbach, the customer can purchase the replacement product at the value of the goods at the time of delivery, or they are obliged to return the replacement product at their own expense.
All further and in particular the statutory provisions on the guarantee are excluded.
8 Liability and exclusion of liability
8.1 Liability
Liability is governed by the applicable statutory provisions. However, TCM SinoSwiss Sarbach is not liable under any circumstances for (i) slight negligence, (ii) indirect and consequential damages and lost profits, (iii) unrealized savings, (iv) damages resulting from late delivery and (v) any actions or omissions by TCM SinoSwiss Sarbach's vicarious agents, whether contractual or non-contractual.
In addition, TCM SinoSwiss Sarbach rejects liability in the following cases:
• improper, non-contractual or illegal storage, setting or use of the products;
• use of incompatible spare parts or accessories (e.g. power supply);
• failure to maintain and/or improper modification or repair of the products by the customer or a third party;
• force majeure, in particular natural disasters, moisture, falls and impact damage, etc., for which TCM SinoSwiss Sarbach is not responsible, and official orders.
8.2. Limitations of liability
TCM SinoSwiss Sarbach excludes all liability for losses or damages of any kind - be it direct, indirect or consequential damages - that may arise from the use of or access to the sarbach.swiss websites or from links to third-party websites. TCM SinoSwiss Sarbach does not guarantee that the individual parts of its website will function without errors. In addition, TCM SinoSwiss Sarbach rejects all liability for manipulation of the Internet user's computer system by unauthorized persons.
8.3. Obligations and liability of the customer
The customer is obliged to keep the login data for the customer account strictly confidential and takes appropriate measures to protect their account from unauthorized access, such as in particular using a secure password, using two-factor authentication, using current browser versions and anti-virus software/measures, etc.
All actions, in particular orders, which are processed via the customer's customer account, are attributed to the customer. In particular, the customer is liable for orders placed via their customer account.
9 Payment
9.1 Payment options
TCM SinoSwiss Sarbach asserts all payment claims for products and services purchased via the TCM SinoSwiss Sarbach online shop or in the SZG directly from the customer. Upon conclusion of the purchase contract, the dealer assigns the entire payment claim arising from the purchase contract between him and the customer to TCM SinoSwiss Sarbach (assignment). The customer acknowledges this assignment and is obliged to make all payments exclusively to TCM SinoSwiss Sarbach.
Payments must be made in Swiss francs.
Cash payment is only possible for TCM SinoSwiss Sarbach products in the event of a branch pickup or services that are provided in the branch.
The customer has access to the payment options offered as a means of payment in the online shop under "Payment options".
The current payment fees that may be charged by TCM SinoSwiss Sarbach can be found under "Payment options" and are shown in detail in the ordering process.
If you pay by credit card or other instant payment methods, the charge is made when you place your order.
If you pay in advance, delivery will only take place after payment has been received. The products in the central warehouse of TCM SinoSwiss Sarbach are reserved until the payment period of at least 11 calendar days has expired. This also applies to products that are initially ordered externally but are processed and shipped via our warehouse.
When purchasing on account, the customer is obliged to pay the invoice amount within 20 calendar days of receiving the delivery or service without any (discount) deduction. In the event of a partial return of the delivered products, the invoice amount can be reduced accordingly.
9.2 Default in payment
If the customer fails to meet their payment obligations in whole or in part, all outstanding amounts owed by the customer to TCM SinoSwiss Sarbach under any title will become due immediately (with advance payment within 8 calendar days of the first reminder) and TCM SinoSwiss Sarbach can demand these immediately and stop further deliveries of products to the customer.
TCM SinoSwiss Sarbach charges a handling fee of CHF 5.00 for the second reminder and a handling fee of CHF 20.00 for the third reminder. If reminders are unsuccessful, the invoice amounts can be assigned to a company commissioned to collect the debt. In this case, an effective annual interest rate of up to 15% on the invoice amount owed from the due date can also be charged. The company commissioned to collect the debt will claim the outstanding amounts in its own name and on its own account and can charge additional processing fees.
9.3 Retention of title
Ordered products remain the property of TCM SinoSwiss Sarbach until full payment has been made to TCM SinoSwiss Sarbach. TCM SinoSwiss Sarbach is entitled to make a corresponding entry in the retention of title register. Before the transfer of ownership, pledging, transfer of ownership by way of security, processing or modification is not permitted without the express consent of TCM SinoSwiss Sarbach.
10 Changes to the order or cancellation
Orders oblige the customer to accept the products and services. TCM SinoSwiss Sarbach can accept subsequent changes or cancellations of orders of products by the customer at its own discretion and charge a handling fee of 20% of the canceled product order value, as well as any loss in value of the canceled products since they were ordered. The remaining amount will be transferred back to the customer. If the service is canceled less than 24 hours in advance, the customer will be charged the full amount.
If a (partial) impossibility of delivery (resolutive condition) occurs after an order has been placed or the contract has been concluded in accordance with section 3, the customer will be informed immediately by email. If the customer has already paid, this amount will be refunded. If no payment has been made, the customer is released from the obligation to pay. Further claims due to late delivery or failure of delivery are excluded.
11 Return of faultless goods
The customer must register the return of the products via their personal customer account at www.sarbach.swiss and, after receiving confirmation of the return from sarbach.swiss, send them back or hand them in at one of the branches . The products must be properly packaged in the original packaging with all accessories. Damaged products will not be taken back or will be invoiced to the customer in full.
If the customer exercises their right of return, TCM SinoSwiss Sarbach will refund the entire purchase price less any small order surcharge paid and the return costs listed in the return guidelines. For clothing and shoes, returns are free of charge for the customer.
In connection with every return of products for which import customs clearance has taken place in the name of the customer, the customer authorizes and instructs TCM SinoSwiss Sarbach to declare the returned products for export and to apply for any refund of Swiss import duties in the name and on behalf of the customer. If the customer was unable to deduct the import tax or was only able to deduct part of it as input tax and the other requirements for import tax refund due to re-export of the ordered products are met, TCM SinoSwiss Sarbach will refund the customer the import tax paid in advance after receiving the corresponding amount from the Federal Customs Administration. For companies registered in the Swiss or Liechtenstein VAT register, proof of the non-deductibility of the import tax must be provided by means of a corresponding confirmation from the Federal Tax Administration. In this context, the customer assures TCM SinoSwiss Sarbach that the information and list of returned products according to the return slip generated by the customer during the return process are complete and accurate, and that the return shipment actually contains the products specified in the return slip . The customer fully indemnifies TCM SinoSwiss Sarbach against all third-party claims related to an incomplete or incorrect customs declaration caused by the customer. TCM SinoSwiss Sarbach has the right to check the customer's information as part of random checks.
12 Repairs outside the warranty
The costs for repairs outside the warranty according to section 7 are borne by the customer. For products that do not have any detectable defects or where the defect is not covered by the warranty according to section 7, TCM SinoSwiss Sarbach reserves the right to charge the customer for the costs of examining the alleged defect and the shipping costs.
13 Community
By publishing comments and contributions in our community, the author confirms that he or she agrees to the community conditions of TCM SinoSwiss Sarbach.
14 Further provisions
14.1 Unassignable returns
Returns that cannot be assigned to a customer or returned to the customer will be kept by TCM SinoSwiss Sarbach for six months and then disposed of.
14.2 Guaranteed goods not collected or undeliverable
If goods that are related to the provision of the guarantee in accordance with section 7 are not collected from the branches within six months of the collection request being sent to the customer or if the goods cannot be returned to them, TCM SinoSwiss Sarbach is entitled to dispose of the goods, in particular to dispose of them.
14.3 Data protection
The data protection declaration on the homepage "sarbach.swiss" of the online shop and SZG applies to the processing of personal data by TCM SinoSwiss Sarbach.
14.4 Partial invalidity
If individual provisions of these General Terms and Conditions are invalid or ineffective, this has no influence on the effectiveness of the remaining provisions and these General Terms and Conditions as a whole.
14.5 Place of jurisdiction and applicable law
All legal relationships between TCM SinoSwiss Sarbach and the customer are subject to substantive Swiss law.
The following exclusive places of jurisdiction apply:

For claims brought by consumers, their place of residence or Visp is the place of jurisdiction.
14.6 Copyright notice
All rights, namely copyrights, to these General Terms and Conditions are held by TCM SinoSwiss Sarbach.
Any reproduction, distribution or other use is prohibited and only permitted with the express written consent of TCM SinoSwiss Sarbach. In the event of a breach of this requirement, TCM SinoSwiss Sarbach reserves the right to take all legal action.

Die Allgemeinen Geschäftsbedingungen (nachfolgend "AGB" genannt) gelten für sämtliche Rechtsgeschäfte, die über den Onlineshop (nachfolgend "Onlineshop" genannt) über die Homepage « www.sarbach.swiss» und vor Ort in einer Filiale von SZG Sarbach Zentrum für Gesundheit (nachfolgend «SZG» genannt) abgeschlossen werden. TCM SinoSwiss Sarbach behält sich das Recht vor, diese AGB jederzeit zu ändern. Massgebend ist jeweils die zum Zeitpunkt der Bestellung geltende Version dieser AGB, welche für diese Bestellung nicht einseitig geändert werden können. Entgegenstehende oder von diesen AGB abweichende Bedingungen der Kundschaft werden nicht anerkannt.
Das Angebot von Produkten und Dienstleistungen im Onlineshop und SZG richtet sich an eine Kundschaft weltweit.
Lieferungen erfolgen an Adressen in der Schweiz und international.
Das Angebot gilt, solange das Produkt über die Suchmaschine im Onlineshop und SZG auffindbar ist und/oder der Vorrat reicht.
Bestellungen in nicht haushaltsüblichen Mengen können ohne Begründung abgelehnt werden.
2 Information
2.1 Produkt und Preis
Abbildungen von Produkten in Werbung, Prospekten, Onlineshop usw. dienen der Illustration und sind unverbindlich.
Alle im Onlineshop und SZG publizierten Verkaufspreise stellen Endpreise dar, sämtliche Steuern (insb. MwSt.), allfällige vorgezogene Recyclinggebühren (vRG), Kosten für Verpackung/en, Lieferkosten und sämtliche weitere allfälligen Abgaben, Gebühren, oder Kosten werden klar angegeben. TCM SinoSwiss Sarbach behält sich das Recht vor, die Preise der angebotenen Produkte und Dienstleistungen jederzeit zu ändern. Massgebend für das Zustandekommen des Kaufvertrags ist der Preis im Onlineshop zum Zeitpunkt der Bestellung.
2.2 Verfügbarkeit und Lieferzeit
TCM SinoSwiss Sarbach legt grossen Wert darauf, Verfügbarkeiten und Lieferzeiten im Onlineshop und SZG aktuell und genau anzugeben. Insbesondere aufgrund von Produktions- oder Lieferengpässen kann es jedoch zu Lieferverzögerungen kommen. Alle Angaben zur Verfügbarkeit und Lieferzeit sind deshalb ohne Gewähr und können sich jederzeit ändern.
3 Vertragsabschluss
Die Produkte und Preise im Onlineshop gelten als Angebot. Dieses Angebot steht jedoch immer unter der den Vertrag auflösenden Bedingung einer Lieferunmöglichkeit oder einer fehlerhaften Preisangabe.
Der Kaufvertrag kommt für Produkte oder Dienstleistungen von TCM SinoSwiss Sarbach zustande, sobald die Kundschaft im Onlineshop oder SZG, in einer der Filialen, per Telefon oder E-Mail ihre Bestellung aufgibt (nachfolgend "Kaufvertrag" genannt).
Das Eintreffen einer Online-Bestellung wird der Kundschaft mittels einer automatisch generierten Bestellbestätigung von Onlineshop sarbach.swiss an die von ihr angegebene E-Mail-Adresse angezeigt. Der Erhalt der automatisch generierten Bestellungsbestätigung enthält keine Zusage, dass das Produkt auch tatsächlich geliefert werden kann. Sie zeigt der Kundschaft lediglich an, dass die abgegebene Bestellung beim Onlineshop eingetroffen und somit der Vertrag mit TCM SinoSwiss Sarbach unter der Bedingung der Liefermöglichkeit und der korrekten Preisangabe zustande gekommen ist.
4 Liefertermin
Mit der Bestellbestätigung wird der Kundschaft ein provisorischer Liefertermin mitgeteilt oder es wird mit der Kundschaft Kontakt aufgenommen und ein individueller Liefertermin vereinbart.
Kommt Onlineshop sarbach.swiss oder SZG in Lieferverzug, so steht der Kundschaft (ausser bei Spezialbestellungen) ab dem 30. Kalendertag seitdem ursprünglich angekündigten Liefertermin das Recht zu, vom Vertrag zurück zu treten. In diesem Fall erstattet sarbach.swiss der Kundschaft bereits im Voraus bezahlte Beträge zurück. Darüberhinausgehende Ansprüche gegenüber Onlineshop sarbach.swiss oder SZG und TCM SinoSwiss Sarbach bestehen nicht.
5 Lieferung / Filialabholung
Bei Produkten und Dienstleistungen von TCM SinoSwiss Sarbach stehen der Kundschaft sämtliche Liefer- und Abholoptionen zur Verfügung, welche im Onlineshop sarbach.swiss oder im SZG vermerkt sind.
Nimmt die Kundschaft die bestellten Produkte am vereinbarten oder angezeigten Liefertermin nicht entgegen, kann TCM SinoSwiss Sarbach den Vertrag auflösen (stornieren) und der Kundschaft die entstandenen Lieferkosten und allfällige Wertverluste in Rechnung stellen.
Falls die Kundschaft die in eine Filiale (Filialabholung) bestellten Produkte nicht innerhalb von 14 Kalendertagen seit der Abholbereitschaft in der Filiale abholt, kann TCM SinoSwiss Sarbach den Vertrag auflösen (stornieren).
6 Prüfpflicht
Die Kundschaft hat gelieferte oder abgeholte Produkte sofort auf Richtigkeit, Vollständigkeit und Lieferschäden zu prüfen.
Lieferschäden, Falsch- und unvollständige Lieferungen sind TCM SinoSwiss Sarbach über den Onlineshop sarbach.swiss oder im SZG innert 5 Kalendertagen ab dem Zeitpunkt der Abholung respektive der Zustellung zu melden. Der Kundschaft ist bewusst, dass eine solche Meldung über das persönliche Kundenkonto im Onlineshop zu erfolgen hat. Ein solches Produkt darf die Kundschaft nicht in Betrieb nehmen oder Verwenden. Sie hat es wie erhalten in der Originalverpackung zurückzusenden oder in einer der Filialen abzugeben.
7 Gewährleistung
7.1 Grundbestimmungen
TCM SinoSwiss Sarbach übernimmt während 2 Monaten nach der Lieferung bzw. Filialabholung die Garantie für Mängelfreiheit und Funktionsfähigkeit des bestellten Produktes. Die Garantiedauer läuft ungeachtet der Erbringung allfälliger Garantieleistungen weiter. TCM SinoSwiss Sarbach kann die Garantie wahlweise durch
- kostenlose Reparatur (ursprüngliche Garantiefrist läuft auf gesamten Produkten weiter);
- teilweisen oder vollständigen Ersatz durch ein gleichwertiges gebrauchtes Produkt.
- Ersatz durch ein neues Produkt durch TCM SinoSwiss Sarbach (neue Garantiefrist von 2 Monaten ab Ersatz)
- Gutschrift zum Tagespreis, (maximal den Verkaufspreis im Zeitpunkt der Bestellung); oder
- Minderung
erbringen.
Verschleissteile wie insbesondere Batterien, Akkus, Netzkabel, Adapter, Leuchtmittel sowie Softwareprobleme sind von TCM SinoSwiss Sarbach von der Garantie ausgenommen. Im Übrigen gelten die Haftungsausschlüsse gemäss Ziffer 8.
Sofern die Herstellergarantie über die Garantie von TCM SinoSwiss Sarbach hinausgeht, räumt TCM SinoSwiss Sarbach diese der Kundschaft ebenfalls ein.
TCM SinoSwiss Sarbach kann der Kundschaft während der Prüfung des Garantieanspruchs nach freiem Ermessen ein Ersatzprodukt / Austauschprodukt zur Verfügung stellen (Austausch unter Vorbehalt). Dies erfolgt unter der (aufschiebenden) Bedingung, dass tatsächlich ein Garantiefall vorliegt. Somit erlangt die Kundschaft erst im Zeitpunkt der Garantiezusage durch TCM SinoSwiss Sarbach Eigentum am Ersatzprodukt. Bei Ablehnung eines Garantiefalls durch TCM SinoSwiss Sarbach kann die Kundschaft das Ersatzprodukt zum Warenwert zum Zeitpunkt der Aushändigung erwerben, oder sie ist verpflichtet, das Ersatzprodukt auf eigene Kosten zurückzusenden.
Alle weitergehenden und insbesondere die gesetzlichen Bestimmungen zur Gewährleistung werden ausgeschlossen.
8 Haftung und Haftungsausschluss
8.1 Haftung
Die Haftung richtet sich nach den anwendbaren gesetzlichen Bestimmungen. Allerdings haftet TCM SinoSwiss Sarbach in keinem Fall für (i) leichte Fahrlässigkeit, (ii) indirekte und mittelbare Schäden und Folgeschäden und entgangenen Gewinn, (iii) nicht realisierte Einsparungen, (iv) Schäden aus Lieferverzug sowie (v) jegliche Handlungen und Unterlassungen der Hilfspersonen von TCM SinoSwiss Sarbach, sei dies vertraglich oder ausservertraglich.
Im Übrigen lehnt TCM SinoSwiss Sarbach die Haftung bei Vorliegen folgender Fälle ab:
- unsachgemässe, vertragswidrige oder widerrechtliche Lagerung, Einstellung oder Benutzung der Produkte;
- Einsatz inkompatibler Ersatz- oder Zubehörteile (z.B. Stromversorgung);
- unterlassene Wartung und/oder unsachgemässe Abänderung oder Reparatur der Produkte durch die Kundschaft oder einen Dritten;
- höhere Gewalt, insbesondere Elementar-, Feuchtigkeits-, Sturz- und Schlagschäden usw., welche nicht durch TCM SinoSwiss Sarbach zu vertreten sind, und behördliche Anordnungen.
8.2. Haftungsbeschränkungen
TCM SinoSwiss Sarbach schliesst uneingeschränkt jede Haftung für Verluste bzw. Schäden irgendwelcher Art aus - sei es für direkte, indirekte oder Folgeschäden -, die sich aus der Benützung der bzw. des Zugriffs auf die sarbach.swiss Websites oder aus Links zu Websites Dritter ergeben sollten. TCM SinoSwiss Sarbach garantiert nicht, dass die einzelnen Teile ihrer Website fehlerlos funktionieren. Zudem lehnt TCM SinoSwiss Sarbach jede Haftung für Manipulationen am EDV-System des Internet-Benutzers durch Unbefugte ab.
8.3. Pflichten und Haftung der Kundschaft
Die Kundschaft ist verpflichtet, die Login-Daten für das Kundenkonto strikt geheim zu halten und unternimmt angemessene Massnahmen, um ihr Konto vor unberechtigten Zugriffen zu schützen, wie insbesondere Verwendung eines sicheren Passworts, Nutzung der Zwei-Faktor-Authentifizierung, Verwendung aktueller Browser-Versionen und Anti-Virensoftwares/-massnahmen etc.
Sämtliche Handlungen, insbesondere Bestellungen, welche über das Kundenkonto der Kundschaft abgewickelt werden, werden der Kundschaft zugerechnet. Insbesondere haftet die Kundschaft für Bestellungen, welche über ihr Kundenkonto getätigt werden.
9 Zahlung
9.1 Zahlungsvarianten
Alle Zahlungsforderungen von Produkten und Dienstleistungen, welche über den Onlineshop von TCM SinoSwiss Sarbach oder im SZG gekauft werden, macht TCM SinoSwiss Sarbach direkt bei der Kundschaft geltend. Der Händler tritt mit Abschluss des Kaufvertrags die gesamte Zahlungsforderung, die im Rahmen des Kaufvertrags zwischen ihm und der Kundschaft entsteht, an TCM SinoSwiss Sarbach ab (Zession). Die Kundschaft nimmt diese Abtretung zur Kenntnis und ist verpflichtet, sämtliche Zahlungen ausschliesslich an TCM SinoSwiss Sarbach zu leisten.
Zahlungen müssen in Schweizer Franken geleistet werden.
Barzahlung ist nur für Produkte von TCM SinoSwiss Sarbach im Falle einer Filialabholung möglich oder Dienstleistungen, die in der Filiale erbracht werden.
Der Kundschaft stehen die als Zahlungsmittel im Onlineshop unter „Zahlungsoptionen“ angebotenen Zahlungsmöglichkeiten zur Verfügung.
Die aktuellen Zahlungsmittelgebühren, welche gegebenenfalls von TCM SinoSwiss Sarbach erhoben werden, sind unter „Zahlungsoptionen“ ersichtlich und werden im Bestellprozess detailliert ausgewiesen.
Bei Zahlung mit Kreditkarte oder anderen Sofort-Zahlungsmitteln erfolgt die Belastung bei Bestellung.
Bei Vorauskasse erfolgt die Lieferung erst nach Eingang der Zahlung. Die Produkte im Zentrallager von TCM SinoSwiss Sarbach werden bis Ablauf der Zahlungsfrist von mindestens 11 Kalendertagen reserviert. Dies betrifft auch Produkte, welche zuerst extern bestellt, aber über unser Lager verarbeitet und verschickt werden.
Bei Kauf auf Rechnung ist die Kundschaft verpflichtet, den Rechnungsbetrag innert 20 Kalendertagen nach Erhalt der Lieferung oder Dienstleistung ohne jeglichen (Skonto-) Abzug zu begleichen. Im Falle einer teilweise erfolgten Rücksendung der gelieferten Produkte kann der Rechnungsbetrag entsprechend reduziert werden.
9.2 Zahlungsverzug
Kommt die Kundschaft ihrer Zahlungsverpflichtungen ganz oder teilweise nicht nach, werden alle offenen Beträge, welche die Kundschaft TCM SinoSwiss Sarbach unter irgendeinem Titel schuldet, sofort (bei Vorauszahlung innert 8 Kalendertagen seit der 1. Mahnung) fällig und TCM SinoSwiss Sarbach kann diese sofort einfordern und weitere Lieferungen von Produkten an die Kundschaft einstellen.
TCM SinoSwiss Sarbach erhebt für die 2. Mahnung eine Umtriebsentschädigung von CHF 5.– und für die 3. Mahnung eine Umtriebsentschädigung von CHF 20.–. Bei erfolglosen Mahnungen können die Rechnungsbeträge an eine mit dem Inkasso beauftragte Firma abgetreten werden. In diesem Fall kann zusätzlich ein effektiver Jahreszins von bis zu 15% auf dem geschuldeten Rechnungsbetrag ab Fälligkeitsdatum in Rechnung gestellt werden. Die mit dem Inkasso beauftragte Firma wird die offenen Beträge in eigenem Namen und auf eigene Rechnung geltend machen und kann zusätzliche Bearbeitungsgebühren erheben.
9.3 Eigentumsvorbehalt
Bestellte Produkte bleiben bis zur vollständigen Bezahlung an TCM SinoSwiss Sarbach im Eigentum von TCM SinoSwiss Sarbach. TCM SinoSwiss Sarbach ist berechtigt, einen entsprechenden Eintrag im Eigentumsvorbehaltsregister vorzunehmen. Vor Eigentumsübergang ist eine Verpfändung, Sicherungsübereignung, Verarbeitung oder Umgestaltung ohne ausdrückliche Einwilligung von TCM SinoSwiss Sarbach nicht zulässig.
10 Änderung der Bestellung oder Stornierung
Bestellungen verpflichten die Kundschaft zur Abnahme der Produkte und Leistungen. Nachträgliche Änderungen oder Stornierungen von Bestellungen von Produkten der Kundschaft kann TCM SinoSwiss Sarbach nach freiem Ermessen akzeptieren und eine Umtriebs-Entschädigung von 20% des stornierten Bestellwerts, sowie den allfälligen Wertverlust der stornierten Produkte seit deren Bestellung in Rechnung stellen. Der restliche Betrag wird dem Kunden zurücküberwiesen. Bei einem Storno der Dienstleistung weniger als 24 Stunden vorher wird der volle Betrag den Kunden in Rechnung gestellt.
Tritt nach einer Bestellung bzw. dem Vertragsabschluss gemäss Ziffer 3 eine (Teil-) Lieferunmöglichkeit (auflösende Bedingung) ein, wird die Kundschaft umgehend per E-Mail informiert. Falls die Kundschaft bereits bezahlt hat, wird ihr dieser Betrag zurückerstattet. Ist noch keine Zahlung erfolgt, wird die Kundschaft von der Zahlungspflicht befreit. Weitere Ansprüche wegen Lieferverzug oder Ausfall der Lieferung sind ausgeschlossen.
11 Rückgabe von mängelfreier Ware
Die Kundschaft muss die Rückgabe der Produkte über das persönliche Kundenkonto auf www.sarbach.swiss anmelden und nach Erhalt der Bestätigung zur Rücknahme durch sarbach.swiss zurücksenden oder in einer der Filialen abgeben. Die Produkte sind mit sämtlichem Zubehör in der Originalverpackung fachgerecht zu verpacken. Beschädigte Produkte werden nicht zurückgenommen bzw. werden dem Kunden vollständig in Rechnung gestellt.
Macht die Kundschaft von ihrem Rückgaberecht Gebrauch, erstattet ihr TCM SinoSwiss Sarbach den gesamten Kaufpreis abzüglich des allenfalls bezahlten Mindermengenzuschlags und der in den Rückgaberichtlinien aufgeführten Rücksendekosten zurück. Bei Bekleidung und Schuhen ist die Rücksendung für die Kundschaft kostenlos.
Im Zusammenhang mit jeder Rückgabe von Produkten, bei denen die Einfuhrverzollung im Namen der Kundschaft stattgefunden hat, ermächtigt und beauftragt die Kundschaft TCM SinoSwiss Sarbach mit der Ausfuhrzollanmeldung der zurückgegebenen Produkte und Beantragung einer allfälligen Erstattung der Schweizer Eingangsabgaben im Namen und im Auftrag der Kundschaft. Sofern die Kundschaft die Einfuhrsteuer nicht oder nur teilweise als Vorsteuer abziehen konnte und die übrigen Voraussetzungen der Einfuhrsteuererstattung wegen Wiederausfuhr der bestellten Produkte vorliegen, erstattet TCM SinoSwiss Sarbach der Kundschaft die von ihr im Voraus bezahlte Einfuhrsteuer nach Erhalt des entsprechenden Betrages von der Eidgenössischen Zollverwaltung. Bei im Schweizer oder liechtensteinischen Mehrwertsteuerregister geführten Unternehmen ist der Nachweis der Nichtabziehbarkeit der Einfuhrsteuer durch entsprechende Bestätigung der Eidgenössischen Steuerverwaltung zu führen.
Die Kundschaft sichert TCM SinoSwiss Sarbach in diesem Zusammenhang zu, dass die Angaben und Auflistung der zurückgegebenen Produkte gemäss dem von der Kundschaft im Rückgabeprozess generierten Retourenschein vollständig und zutreffend sind, und die Retourensendung tatsächlich die im Retourenschein bezeichneten Produkte enthält. Die Kundschaft hält TCM SinoSwiss Sarbach von sämtlichen Drittansprüchen, die im Zusammenhang mit einer durch die Kundschaft verursachten, unvollständigen oder unrichtigen Zollanmeldung stehen, vollumfänglich schadlos. TCM SinoSwiss Sarbach steht das Recht zu, die Angaben der Kundschaft im Rahmen von Stichproben zu kontrollieren.
12 Reparatur ausserhalb der Gewährleistung
Die Kosten für eine Reparatur ausserhalb der Gewährleistung gemäss Ziffer 7 gehen zu Lasten des Kunden. Bei Produkten, welche keine feststellbaren Fehler aufweisen oder bei denen der Mangel nicht unter die Gewährleistung gemäss Ziffer 7 fällt, behält sich TCM SinoSwiss Sarbach vor, die Kosten für die Prüfung des geltend gemachten Mangels sowie die Versandkosten der Kundschaft in Rechnung zu stellen.

Mit der Publikation von Kommentaren und Beiträgen in unserer Community, bestätigt der Urheber, mit den Community-Bedingungen von TCM SinoSwiss Sarbach einverstanden zu sein.
14 Weitere Bestimmungen
14.1 Nicht zuordenbare Rücksendungen
Rücksendungen, die keiner Kundschaft zugeordnet oder der Kundschaft nicht retourniert werden können, werden sechs Monate von TCM SinoSwiss Sarbach aufbewahrt und dann entsorgt.
14.2 Nicht abgeholte oder nicht zustellbare Garantieware
Wird Ware, die im Zusammenhang mit der Gewährleistungserbringung gemäss Ziffer 7 steht, in den Filialen nicht innert sechs Monaten seit Versendung der Abholaufforderung an die Kundschaft abgeholt oder kann ihr die Ware nicht retourniert werden, so ist TCM SinoSwiss Sarbach berechtigt, über die Ware zu verfügen, insbesondere diese zu entsorgen.
14.3 Datenschutz
Für die Bearbeitung von Personendaten durch TCM SinoSwiss Sarbach gilt die Datenschutzerklärung in der Homepage «sarbach.swiss» vom Onlineshop und SZG.
14.4 Teilungültigkeit
Sollten einzelne Bestimmungen dieser AGB ungültig oder unwirksam sein, so hat dies keinen Einfluss auf die Wirksamkeit der übrigen Bestimmungen und dieser AGB insgesamt.
14.5 Gerichtsstand und anwendbares Recht
Sämtliche Rechtsbeziehungen zwischen TCM SinoSwiss Sarbach und der Kundschaft unterstehen materiellem Schweizer Recht.
Es gelten folgende ausschliesslichen Gerichtstände:

2 Information
2.1 Produit et prix

3 Conclusion du contrat
Les produits et les prix indiqués dans la boutique en ligne sont considérés comme une offre. Cette offre est cependant toujours soumise à la condition résolutoire du contrat, à savoir une impossibilité de livraison ou une indication de prix erronée.
Le contrat de vente est conclu pour les produits ou les services de TCM SinoSwiss Sarbach dès que la clientèle passe sa commande dans la boutique en ligne ou le CCM, dans l'une des succursales, par téléphone ou par e-mail (ci-après dénommé « contrat de vente »).
L'arrivée d'une commande en ligne est signalée au client par une confirmation de commande générée automatiquement par Onlineshop sarbach.swiss à l'adresse e-mail indiquée par le client. La réception de la confirmation de commande générée automatiquement ne constitue pas une promesse de livraison effective du produit. Elle indique uniquement au client que la commande passée a été reçue par la boutique en ligne et que le contrat avec TCM SinoSwiss Sarbach est donc conclu sous réserve de la possibilité de livraison et de l'indication correcte du prix.
4 Date de livraison
Une date de livraison provisoire est communiquée à la clientèle avec la confirmation de commande ou un contact est pris avec la clientèle pour convenir d'une date de livraison individuelle.
Si Onlineshop sarbach.swiss ou SZG est en retard de livraison, le client a le droit de résilier le contrat (sauf pour les commandes spéciales) à partir du 30e jour calendaire suivant la date de livraison initialement annoncée. Dans ce cas, sarbach.swiss rembourse au client les montants déjà payés à l'avance. Il n'existe aucune autre prétention à l'égard de la boutique en ligne sarbach.swiss ou de la CCM et de TCM SinoSwiss Sarbach.
5 Livraison / retrait en magasin
Pour les produits et services de TCM SinoSwiss Sarbach, la clientèle dispose de toutes les options de livraison et de retrait indiquées dans la boutique en ligne sarbach.swiss ou dans le GCC.
Si la clientèle ne réceptionne pas les produits commandés à la date de livraison convenue ou indiquée, TCM SinoSwiss Sarbach peut résilier le contrat (annulation).

Si les clients ne retirent pas les produits commandés dans une succursale dans un délai de 14 jours calendaires à compter de la date à laquelle les produits sont prêts à être retirés dans la succursale (retrait en succursale), TCM SinoSwiss Sarbach peut résilier le contrat (annulation).
6 Obligation de contrôle
La clientèle est tenue de vérifier immédiatement les produits livrés ou retirés quant à leur exactitude, leur intégralité et les dommages de livraison.
Les dommages de livraison, les livraisons erronées ou incomplètes doivent être signalés à TCM SinoSwiss Sarbach via la boutique en ligne sarbach.swiss ou au CCM dans un délai de 5 jours calendaires à compter de la date d'enlèvement ou de livraison. Le client est conscient qu'une telle notification doit être effectuée via son compte client personnel dans la boutique en ligne. Le client n'est pas autorisé à mettre en service ou à utiliser un tel produit. Il doit le renvoyer tel quel dans son emballage d'origine ou le déposer dans l'une des filiales.
7 Garantie
7.1 Dispositions de base
TCM SinoSwiss Sarbach garantit l'absence de défauts et le bon fonctionnement du produit commandé pendant 2 mois à compter de la livraison ou de l'enlèvement en magasin. La durée de la garantie se poursuit nonobstant la fourniture d'éventuelles prestations de garantie. TCM SinoSwiss Sarbach peut choisir d'annuler la garantie par
- Réparation gratuite (le délai de garantie initial continue de courir sur l'ensemble des produits) ;
- le remplacement partiel ou total par un produit d'occasion équivalent.

Pour le reste, les exclusions de responsabilité prévues au chiffre 8 s'appliquent.
Dans la mesure où la garantie du fabricant dépasse la garantie de TCM SinoSwiss Sarbach, TCM SinoSwiss Sarbach l'accorde également à sa clientèle.
Pendant l'examen du droit à la garantie, TCM SinoSwiss Sarbach peut, à sa libre appréciation, mettre à la disposition du client un produit de remplacement / un produit d'échange (échange sous réserve). Cela se fait à la condition (suspensive) qu'il y ait effectivement un cas de garantie. Ainsi, le client n'acquiert la propriété du produit de remplacement qu'au moment de l'acceptation de la garantie par TCM SinoSwiss Sarbach. En cas de refus d'un cas de garantie par TCM SinoSwiss Sarbach, le client peut acquérir le produit de remplacement à la valeur de la marchandise au moment de la remise, ou il est tenu de renvoyer le produit de remplacement à ses propres frais.
Toutes les autres dispositions relatives à la garantie, et notamment les dispositions légales, sont exclues.
8 Responsabilité et exclusion de responsabilité
8.1 Responsabilité
La responsabilité est régie par les dispositions légales applicables. Toutefois, TCM SinoSwiss Sarbach n'est en aucun cas responsable (i) des négligences légères, (ii) des dommages indirects et consécutifs et du manque à gagner, (iii) des économies non réalisées, (iv) des dommages résultant d'un retard de livraison ainsi que (v) de tous les actes et omissions des auxiliaires de TCM SinoSwiss Sarbach, qu'ils soient contractuels ou extracontractuels.
Par ailleurs, TCM SinoSwiss Sarbach décline toute responsabilité dans les cas suivants :
-stockage, réglage ou utilisation des produits non conformes, contraires au contrat ou illégaux ;
-utilisation de pièces de rechange ou d'accessoires incompatibles (par ex. alimentation électrique) ;
-non-entretien et/ou modification ou réparation inappropriée des produits par le client ou un tiers ;
-force majeure, en particulier dommages dus aux éléments naturels, à l'humidité, aux chutes et aux chocs, etc., qui ne sont pas imputables à TCM SinoSwiss Sarbach, et injonctions des autorités.
8.2 Limites de responsabilité
TCM SinoSwiss Sarbach décline sans restriction toute responsabilité pour les pertes ou les dommages de quelque nature que ce soit - qu'il s'agisse de dommages directs, indirects ou consécutifs - qui pourraient résulter de l'utilisation ou de l'accès aux sites Internet sarbach.swiss ou de liens vers des sites Internet de tiers. TCM SinoSwiss Sarbach ne garantit pas que les différentes parties de son site Internet fonctionnent sans erreur. En outre, TCM SinoSwiss Sarbach décline toute responsabilité en matière de

8.3 Obligations et responsabilité du client

Toutes les actions, en particulier les commandes, qui sont effectuées via le compte client de la clientèle, sont imputées à la clientèle. En particulier, le client est responsable des commandes effectuées via son compte client.
9 Paiement
9.1 Variantes de paiement
TCM SinoSwiss Sarbach fait valoir directement auprès de la clientèle toutes les créances de paiement de produits et de services achetés via la boutique en ligne de TCM SinoSwiss Sarbach ou dans le CCM. Lors de la conclusion du contrat de vente, le commerçant cède à TCM SinoSwiss Sarbach l'intégralité de la créance de paiement qui naît entre lui et la clientèle dans le cadre du contrat de vente (cession). Le client prend connaissance de cette cession et s'engage à effectuer tous les paiements exclusivement à TCM SinoSwiss Sarbach.
Les paiements doivent être effectués en francs suisses.
Le paiement en espèces n'est possible que pour les produits de TCM SinoSwiss Sarbach en cas de retrait en magasin ou pour les services fournis en magasin.
La clientèle dispose des moyens de paiement proposés dans la boutique en ligne sous « Options de paiement ».
Les frais actuels liés aux moyens de paiement, éventuellement prélevés par TCM SinoSwiss Sarbach, sont indiqués sous « Options de paiement » et sont détaillés lors du processus de commande.
En cas de paiement par carte de crédit ou autre moyen de paiement immédiat, le débit est effectué à la commande.
En cas de paiement anticipé, la livraison n'a lieu qu'après réception du paiement. Les produits stockés dans l'entrepôt central de TCM SinoSwiss Sarbach sont réservés jusqu'à l'expiration du délai de paiement d'au moins 11 jours civils. Cela concerne également les produits qui sont d'abord commandés à l'extérieur, mais qui sont traités et expédiés via notre entrepôt.
En cas d'achat sur facture, le client est tenu de régler le montant de la facture dans les 20 jours calendaires suivant la réception de la livraison ou du service, sans aucune déduction (d'escompte).

TCM SinoSwiss Sarbach prélève une indemnité de 5 CHF pour le 2e rappel et une indemnité de 20 CHF pour le 3e rappel. En cas de rappels infructueux, les montants des factures peuvent être cédés à une entreprise chargée de l'encaissement. Dans ce cas, un intérêt annuel effectif pouvant aller jusqu'à 15% peut être facturé en plus sur le montant de la facture due à partir de la date d'échéance. La société chargée de l'encaissement fera valoir les montants impayés en son propre nom et pour son propre compte et pourra prélever des frais de traitement supplémentaires.
9.3 Réserve de propriété
Les produits commandés restent la propriété de TCM SinoSwiss Sarbach jusqu'à leur paiement intégral à TCM SinoSwiss Sarbach. TCM SinoSwiss Sarbach est en droit de procéder à une inscription correspondante dans le registre des pactes de réserve de propriété. Avant le transfert de propriété, la mise en gage, le transfert de propriété à titre de garantie, le traitement ou la transformation ne sont pas autorisés sans l'accord exprès de TCM SinoSwiss Sarbach.
10 Modification de la commande ou annulation
Les commandes engagent la clientèle à accepter les produits et les prestations. TCM SinoSwiss Sarbach peut librement accepter des modifications ou des annulations ultérieures de commandes des produits de la clientèle et facturer une indemnité de 20% de la valeur de la commande annulée, ainsi que l'éventuelle perte de valeur des produits annulés depuis leur commande. Le montant restant sera reversé au client. Si la prestation est annulée moins de 24 heures à l’avance, le montant total sera facturé au client.
Si une impossibilité (partielle) de livraison (condition résolutoire) survient après une commande ou la conclusion du contrat selon le chiffre 3, le client en sera immédiatement informé par e-mail. Si le client a déjà payé, ce montant lui sera remboursé. Si aucun paiement n'a encore été effectué, le client est libéré de son obligation de paiement. Toute autre revendication pour cause de retard ou de non-livraison est exclue.
11 Retour de marchandises sans défaut
La clientèle doit annoncer le retour des produits via son compte client personnel sur www.sarbach.swiss et, après réception de la confirmation de reprise par sarbach.swiss, les renvoyer ou les déposer dans l'une des succursales. Les produits doivent être emballés correctement avec tous les accessoires dans leur emballage d'origine. Les produits endommagés ne seront pas repris ou seront entièrement facturés au client.
Si le client fait usage de son droit de retour, TCM SinoSwiss Sarbach lui rembourse l'intégralité du prix d'achat, déduction faite du supplément pour petites quantités éventuellement payé et des frais de retour mentionnés dans les directives de retour. Pour les vêtements et les chaussures, le retour est gratuit pour la clientèle.
Dans le cadre de chaque retour de produits pour lesquels le dédouanement à l'importation a été effectué au nom du client, ce dernier autorise et charge TCM SinoSwiss Sarbach de la déclaration d'exportation des produits retournés et de la demande de remboursement éventuel des droits d'entrée suisses au nom et pour le compte du client. Dans la mesure où la clientèle n'a pas pu déduire l'impôt sur les importations ou n'a pu le déduire que partiellement en tant qu'impôt préalable et que les autres conditions du remboursement de l'impôt sur les importations en raison de la réexportation des produits commandés sont remplies, TCM SinoSwiss Sarbach rembourse à la clientèle l'impôt sur les importations qu'elle a payé à l'avance après avoir reçu le montant correspondant de l'Administration fédérale des douanes. Pour les entreprises inscrites au registre suisse ou liechtensteinois de la TVA, la preuve de la non-déductibilité de l'impôt sur les importations doit être apportée par une attestation correspondante de l'Administration fédérale des contributions.
Dans ce contexte, le client garantit à TCM SinoSwiss Sarbach que les indications et la liste des produits retournés sont complètes et exactes conformément au bon de retour généré par le client dans le cadre du processus de retour, et que l'envoi en retour contient effectivement les produits désignés dans le bon de retour. Le client indemnise intégralement TCM SinoSwiss Sarbach de toutes les prétentions de tiers qui sont en rapport avec une déclaration en douane incomplète ou incorrecte causée par le client. TCM SinoSwiss Sarbach a le droit de contrôler les données du client dans le cadre de sondages.
12 Réparation hors garantie
Les coûts d'une réparation hors garantie selon le chiffre 7 sont à la charge du client. Pour les produits qui ne présentent pas de défauts constatables ou pour lesquels le défaut ne relève pas de la garantie selon le chiffre 7, TCM SinoSwiss Sarbach se réserve le droit de facturer à la clientèle les frais de contrôle du défaut invoqué ainsi que les frais d'envoi.
13 Communauté
En publiant des commentaires et des contributions dans notre communauté, l'auteur confirme être d'accord avec les conditions de la communauté de TCM SinoSwiss Sarbach.
14 Autres dispositions
14.1 Retours non attribuables
Les retours qui ne peuvent pas être attribués à un client ou qui ne peuvent pas être retournés au client sont conservés pendant six mois par TCM SinoSwiss Sarbach avant d'être éliminés.
14.2 Marchandise sous garantie non retirée ou non distribuable
Si la marchandise en rapport avec l'exécution de la garantie selon le chiffre 7 n'est pas retirée dans les filiales dans les six mois suivant l'envoi de la demande d'enlèvement à la clientèle ou si la marchandise ne peut pas lui être retournée, TCM SinoSwiss Sarbach est en droit de disposer de la marchandise, notamment de l'éliminer.
14.3 Protection des données
Le traitement des données personnelles par TCM SinoSwiss Sarbach est régi par la déclaration de protection des données figurant sur la page d'accueil « sarbach.swiss » de la boutique en ligne et de la CCM.
14.4 Validité partielle
Si certaines dispositions des présentes CGV sont invalides ou inefficaces, cela n'a aucune influence sur la validité des autres dispositions et des présentes CGV dans leur ensemble.
14.5 For juridique et droit applicable
Toutes les relations juridiques entre TCM SinoSwiss Sarbach et la clientèle sont soumises au droit matériel suisse.
Les fors exclusifs suivants sont applicables :
Pour toutes les prétentions découlant de contrats de vente dans lesquels TCM SinoSwiss Sarbach est partie contractante : pour les plaintes des consommatrices et des consommateurs, le for est leur domicile ou Viège.
14.6 Remarque concernant les droits d'auteur
Tous les droits, notamment les droits d'auteur, relatifs aux présentes CGV sont détenus par TCM SinoSwiss Sarbach.
Toute reproduction, diffusion ou autre utilisation est interdite et n'est autorisée qu'avec l'accord exprès et écrit de TCM SinoSwiss Sarbach. En cas de non-respect de cette disposition, TCM SinoSwiss Sarbach se réserve le droit de prendre toutes les mesures juridiques qui s'imposent.
